Patent Prosecution

High technology patent prosecution, both U.S. and foreign, is a core focus of our firm.

We have drafted and prosecuted hundreds of patent applications in a wide array of complex technologies, a few examples of which include optics, photonics, nanotechnology, telecommunications, semiconductor devices and processing, computer hardware, plasma modeling, integrated circuits, spectroscopy, and fuel cells. Over the years, we have received enthusiastic appreciation from our clients for our work.

We draw upon our experience in patent litigation to draft and prosecute patents that can provide robust protection against infringement as well as withstand challenges during litigation. We also regularly monitor rapidly changing patent case law to ensure conformity with best practices under current law.

 

Intellectual Property Strategy and Counseling

We help our clients define the business objectives of their intellectual property, and strategically plan and develop their patent portfolios in alignment with these business objectives.

Our patent portfolio planning services include evaluating clients’ existing patent portfolios to assess scope of coverage and identify target areas for future patent efforts.

We also perform patent landscape studies to assess competitors’ (or other third parties’) patent positions, and assist clients in avoiding or designing around others’ patents. We counsel clients regarding litigation avoidance and infringement risks.

We regularly provide legal opinions regarding freedom to use / product clearance, infringement, validity, and patentability.

 

Technology Transactions

We advise clients regarding the acquisition and transfer of technology and patent rights.

Our transactional experience includes drafting and negotiating a wide variety of agreements relating to technology transfer, joint development and collaboration, manufacturing and supply, confidentiality and non-disclosure, and sponsored research.

Our experience further includes performing intellectual property due diligence, and advising on intellectual property valuation for transactions such as acquisitions.
